By accessing or using QckServe (available at qckserve.com), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use our platform. We reserve the right to modify these terms at any time, and your continued use of the platform after changes are posted constitutes your acceptance.
2. Eligibility
You must be at least 18 years old to use QckServe. By using our services, you represent and warrant that you have the legal capacity to enter into a binding agreement. If you are using our platform on behalf of a business, you represent that you have the authority to bind that business to these terms.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account. QckServe is not liable for any loss or damage arising from your failure to protect your account information. You may not transfer or assign your account to any other person.
4. Listings & Ads
Users may post classified ads for goods and services subject to our Rules for Posting Ads. QckServe is a platform that connects buyers and sellers — we do not verify the accuracy of listings and are not a party to any transaction between users. You are solely responsible for the content of your ads, including accuracy, legality, and compliance with applicable laws. QckServe reserves the right to remove any listing at its sole discretion.
5. Transactions Between Users
All transactions are directly between buyers and sellers. QckServe does not facilitate payments, guarantee delivery, or verify the quality or authenticity of items listed. We strongly recommend meeting in safe, public locations, verifying items before payment, and using secure payment methods. QckServe is not responsible for any loss, damage, or dispute arising from transactions between users.
6. Prohibited Activities
You agree not to use QckServe to: post false, misleading, or fraudulent listings; sell illegal goods or services; violate any applicable laws or regulations; harass, threaten, or abuse other users; scrape or collect data from our platform without permission; use automated tools or bots to post ads or interact with the platform; attempt to gain unauthorised access to any part of our systems; or engage in any activity that disrupts or damages QckServe's services.
7. Intellectual Property
All content on QckServe, including logos, design, text, and software, is the property of QckServe or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission. By posting content on QckServe, you grant us a non-exclusive, royalty-free licence to display, distribute, and promote that content on our platform.
8. Disclaimer of Warranties
QckServe is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free from viruses or harmful components. We make no guarantees regarding the accuracy or completeness of any listings or content posted by users.
9. Limitation of Liability
To the fullest extent permitted by law, QckServe and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the platform, including loss of profits, data, or goodwill. Our total liability to you for any claim shall not exceed the amount you paid us, if any, in the twelve months preceding the claim.
10. Termination
We reserve the right to suspend or terminate your account and access to QckServe at any time, with or without notice, for any reason including violation of these Terms. Upon termination, your right to use the platform ceases immediately. Sections that by their nature should survive termination shall continue to apply.
11. Governing Law
These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of QckServe shall be subject to the exclusive jurisdiction of the courts in Srinagar, Jammu & Kashmir, India.
